Under the Building Regulations 2018 it is a requirement for the owner to maintain essential safety measures so they operate satisfactorily. Maintenance and testing requirements all fall under the Australian Standard AS1851 – Maintenance of Fire Protection Systems.

Owners are responsible for maintaining all fire safety services or essential safety measures (ESM) for their building. Owners have the option to appoint someone else to handle all fire safety related matters who act and serve as an agent for the building. 

Non-compliance of fire safety or being unwilling to perform necessary fire safety related maintenance tests can put occupants at risk as well as those in surrounding buildings. Non-compliance can also lead to a infringement notice with fines from your local council or fire authorities that can range between $290 to $17,000 for an individual and over $88,000 for a company if they were to be prosecuted.

According to the Victorian Building Authority (VBA), maintenance and servicing of fire safety systems must be completed by a professional with a good understanding of the buildings essential safety measures (ESM).
